Article 5č

If the subject of a referendum is not defined in a request in accordance with Article 5a of this Act or if a question to be posed at the referendum is not formulated in accordance with the definition of the subject of the referendum and Article 5c of this Act, the President of the National Assembly before a session or the National Assembly at a session calls upon proposers to appropriately supplement or correct the request within a determined period of time, which should not be shorter than three days. If they fail to do so, the National Assembly decides not to call a referendum.
 
In instances referred to in the preceding paragraph, the proposers of the request may within eight days after the adoption of the decision of the National Assembly to not call a referendum request that such decision be examined by the Constitutional Court. A representative of the proposers notifies the National Assembly thereof. The Constitutional Court decides on the request within thirty days of receiving the request. If the Constitutional Court determines that the decision of the National Assembly is not justified, it abrogates it.

Article 21

If the National Assembly deems that unconstitutional consequences could occur due to the suspension of the implementation of a law or due to a law not being adopted, it requests that the Constitutional Court decide thereon within the period of time determined in Article 22 of this Act.

The National Assembly may file the request referred to in the preceding paragraph when signatures in support of the referendum request are still being collected.

The Constitutional Court decides on the request referred to in the first paragraph of this article within thirty days.

The request referred to in the first paragraph of this article suspends the collection of signatures and the expiry of the time limit for their collection. If the Constitutional Court decides to dismiss the request of the National Assembly, the collection of signatures continues the next day after the publication of the Constitutional Court decision in the Official Gazette of the Republic of Slovenia.
