Constitutional Court Judge Prof. Dr Ernest Petrič to Visit International Tribunal for the Law of the Sea in Hamburg

In his capacity as President of the UN International Law Commission, Prof. Dr Ernest Petrič, Judge of the Constitutional Court of the Republic of Slovenia, will be visiting the International Tribunal for the Law of the Sea (ITLOS), Hamburg, from 9 - 10 March 2010 upon the invitation of its President Jose Luis Jesus.

The International Law Commission is the most eminent UN body for international law. Its cooperation with international courts and other judicial authorities is aimed at increasing a joint effort for the development of international law and fundamental legal values in different fields.

The International Tribunal for the Law of the Sea was established on the basis of the United Nations Convention on the Law of the Sea (1982) and is competent to rule on disputes between the States Parties to the Convention regarding the application and interpretation of the Law of the Sea, as well as other issues pertaining to the exploitation of the sea, navigation, delimitation and maritime zones. The Court's decisions are binding. In the process of decision-making, the Court relies on the rules of the Convention as well as on other rules of international law; if the parties agree upon it, it may also base its decision on the principle of equity.

The visit of Prof. Dr Petrič to the International Tribunal for the Law of the Sea will in the first place be aimed at giving the judges of ITLOS a closer insight into the work and efforts of the International Law Commission for the development of international law and its codification, particularly into the work of last year. At the same time Judge Petrič will learn about the Court’s case-law and its problems, the judges’ general view of the maritime delimitation issues and about the determination of maritime zones, particularly as in December 2009 Bangladesh and Myanmardecided to bring before this Court their long-standing dispute concerning delimitation of their maritime boundary in the Bay of Bengal.
