The complainant will have the opportunity in the motion against an indictment, or in the subsequent stage of criminal proceedings in the appeal against a judgment, to assert the alleged violations of his constitutional rights, which he has asserted regarding a final order on protective measures in accordance with the provisions of Article 240.a of the Criminal Procedure Act (Official Gazette RS, No. 63/94 et sub. - ZKP). Therefore, the complainant did not demonstrate the procedural prerequisites for filing a constitutional complaint determined in the first and second paragraph of Article 51 of the Constitutional Court Act.
