Abstract:
Petitioners do not need legal protection for the review of the constitutionality or legality of a regulation which ceased to be in force if they do not demonstrate that the consequences of the unconstitutionality or unlawfulness could be remedied by the possible granting of a petition.
 
The Constitutional Court only reviews regulations in force. The Constitutional Court reviews regulations which ceased to be in force only in accordance with the conditions set forth in the second paragraph of Article 47 of the Constitutional Court Act. Due to the fact that the Asylum Act ceased to be in force pending the proceedings before the Constitutional Court, the Constitutional Court rejected the applicants' request.
 
The Constitutional Court discontinues proceedings if a petitioner withdraws a petition.
