Abstract: |
The petition for the review of the constitutionality of the Charter of the Association of the Republic of Slovenia for Private Protection is evidently unfounded, since it originates from erroneous presumptions: the Government only consented to the Charter of the Association in the part that refers to the implementation of public authorities; however executive regulations in force also existed which determined the technical and other conditions for conducting the activity of protection. The petitioner's assertions concerning the issue of who are granted licenses for private protection and concerning the legality and correctness of a procedure of granting licenses cannot be a subject of the constitutional review of a regulation. They may only be a subject of a procedure in which the right of the individual to obtain a license for conducting the activity of private protection is decided upon. |
